4) The Services
Nerix transforms your photos into personalized English name suggestions using advanced AI algorithms. Upload a portrait, add a brief description, and receive tailor-made name ideas intended to reflect personality and style.
We may add, remove, or modify features from time to time.
5) License and acceptable use
License
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use.
Restrictions
- Do not copy, modify, distribute, sell, lease, or sublicense the Services.
- Do not reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
- Do not interfere with or disrupt the Services or bypass security/access restrictions.
- Do not use the Services to violate law or third-party rights.
- Do not upload or submit content you do not have the right to use.
6) User content (photos, images, text inputs, and outputs)
Important: You control whether you upload a photo and whether you generate outputs. Uploaded photos/text are processed on servers operated by Nerix Team, not shared with third parties for processing, and deleted promptly after processing is completed.
Your content
You may submit photos, images, and (where available) text inputs ("User Content") to use the Services. You retain ownership of your User Content.
Permission to process (limited purpose)
You grant us a limited permission to host, process, transmit, and transform your User Content solely to operate the Services and provide the outputs you request.
AI-assisted processing, deletion, and your control
- Your uploaded images and text inputs are processed on servers operated by Nerix Team.
- We do not share your uploaded photos or text inputs with any third party for processing.
- After processing is completed, we delete uploaded photos and related text inputs from our servers promptly.
- Generated results are typically stored locally on your device (subject to your device settings). You can delete them at any time.
Face data and biometrics
- We do not perform face recognition, identity verification, or biometric identification.
- We do not create or store biometric templates from your photos.
No training / no marketing use without consent
- We do not use your uploaded photos, text inputs, or outputs to train machine learning models.
- We do not use your uploaded photos or outputs for advertising or marketing without your explicit consent.
Your responsibility
Do not submit content that is illegal, infringing, hateful, sexually explicit, or otherwise inappropriate, or that violates any third-party rights.
7) Privacy
Our Privacy Policy explains how we collect and use information. By using the Services, you acknowledge that you have read and understood our Privacy Policy.
8) Third-party services
The Services may rely on third-party software or services (for example, platform services provided by Apple). We are not responsible for third-party services that you use separately from the App.
9) Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW.
We do not warrant that the Services will be uninterrupted or error-free, or that outputs will meet your expectations. Outputs are for entertainment and creative purposes only and do not constitute professional advice.
10) Limitation of liability
To the maximum extent permitted by law, Nerix Team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services.
In any case, our total liability for all claims related to the Services will not exceed the amount you paid to us (if any) for the Services in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations; in that case, these limitations apply to the greatest extent permitted by law.
11) Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Nerix Team from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.
12) Termination
We may suspend or terminate your access to the Services if we believe you have violated these Terms or if necessary to protect the Services or other users. You may stop using the Services at any time.
13) Changes to these terms
We may update these Terms from time to time. We will post the updated Terms and update the effective date. Your continued use of the Services after the effective date of the updated Terms means you accept the changes.
14) Governing law
These Terms are governed by the laws of the jurisdiction of Nerix Team’s principal place of business, without regard to conflict of law principles.
15) Dispute resolution and binding arbitration
Please read this section carefully. It affects your legal rights.
Informal resolution
Before starting arbitration, you agree to contact us at junievitia523@outlook.com and try to resolve the dispute informally.
Binding arbitration
If a dispute cannot be resolved informally, it will be resolved by binding arbitration on an individual basis. The arbitration will be conducted in English by a single arbitrator, and, where practical, may be conducted remotely/online. The seat (legal place) of arbitration will be the jurisdiction of our principal place of business, unless applicable law requires otherwise.
Exceptions
Either party may bring a claim in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief to prevent unauthorized use or misuse of intellectual property or to protect rights and safety.
No class actions
You and Nerix Team agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding, to the extent permitted by law.
